These Terms of Use (“Terms”) govern your access to and use of Tidearo, including our website, accounts, profiles, job and training listings, recruitment tools, communications, Feed, Atlas, paid services, and other features made available through the platform (collectively, the “Services”).

By accessing or using Tidearo, creating an account, or purchasing a Service, you agree to these Terms and our Privacy Policy.

If you use Tidearo on behalf of a company, training provider, employer, or other organisation, you confirm that you have authority to act on its behalf.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Tidearo.

You may not use Tidearo where doing so would violate applicable law, sanctions, trade restrictions, or other legal requirements.

2. About Tidearo

Tidearo is a maritime professional platform that connects seafarers, shore-based professionals, employers, crewing and shipping companies, training providers, and other participants in the maritime industry.

Tidearo provides technology that helps users discover opportunities, publish professional information, communicate, apply for jobs, share CVs, find candidates, promote listings, discover training, and use other maritime-related tools.

Unless expressly stated otherwise for a particular Service, Tidearo:

  • does not employ candidates;

  • does not make hiring decisions on behalf of employers;

  • does not operate vessels;

  • does not enter into employment contracts between candidates and employers;

  • does not provide maritime training or issue maritime certificates; and

  • is not a party to agreements entered into directly between users, employers, companies, or training providers.

Employment, engagement, training, certification, contractual, immigration, medical, payroll, and joining decisions remain the responsibility of the relevant parties.

3. Accounts and Profiles

You must provide accurate, current, and complete information when creating and maintaining an account or profile.

You are responsible for:

  • information contained in your profile or CV;

  • qualifications, experience, licences, certificates, availability, and other professional information you provide;

  • keeping your account credentials secure; and

  • activity carried out through your account by persons authorised to use it.

Companies and training providers are responsible for ensuring that persons using their Tidearo workspace or account are properly authorised to act on their behalf.

You must promptly update information that becomes inaccurate or outdated.

Tidearo may restrict certain features, visibility, communications, or access where reasonably necessary for security, verification, legal compliance, or enforcement of these Terms.

4. Jobs, Applications and Recruitment Tools

Tidearo may provide tools that allow users to search for jobs, publish vacancies, submit applications, share CVs, receive recommendations, compare opportunities, communicate with employers, and use recruitment-related automation.

Employers and companies are responsible for the accuracy, legality, and authenticity of their vacancies, employment terms, recruitment practices, and communications with candidates.

Candidates remain responsible for reviewing a vacancy and deciding whether an opportunity is appropriate for them.

Applications

When you apply for a job through Tidearo, you authorise Tidearo to make the information necessary for that application available to the relevant employer, company, recruitment contact, or application system.

Tidearo does not guarantee that an application will be reviewed, answered, accepted, or result in an interview, employment, joining, or any other outcome.

Send CV

Where Send CV is available, the Service allows you to instruct Tidearo to distribute your CV and related professional information to employers or companies selected or identified according to the options and criteria available to you when creating the campaign.

By confirming a Send CV campaign, you authorise Tidearo to transmit the relevant information to those recipients.

Tidearo does not guarantee that every message will be successfully delivered, opened, reviewed, or answered, or that use of Send CV will lead to employment.

Once information has been delivered to a recipient, Tidearo may not be able to retrieve or delete copies held independently by that recipient.

Auto Apply

Where Auto Apply is available, you may authorise Tidearo to perform certain application-related actions on your behalf according to the preferences, eligibility rules, and limits configured for the Service.

You remain responsible for keeping your profile, CV, preferences, and professional information accurate and up to date.

Disabling Auto Apply stops future automated actions where technically possible but does not withdraw or cancel applications that have already been submitted or transmitted.

Auto Apply does not guarantee eligibility, employer interest, an interview, or employment.

5. Matching, Recommendations and Verification

Tidearo may use profile information, professional experience, preferences, vacancy requirements, vessel or fleet information, availability, and other relevant factors to provide matching, rankings, recommendations, or similar tools.

These tools are intended to assist users in discovering potentially relevant candidates, companies, jobs, courses, or other opportunities.

A match, recommendation, ranking, score, or similar result is not:

  • a guarantee of suitability;

  • a hiring decision;

  • professional or regulatory certification;

  • confirmation that all requirements have been satisfied; or

  • a guarantee of any particular outcome.

Tidearo may perform certain checks in connection with companies, training providers, profiles, documents, content, or other information.

Where Tidearo displays a “Verified”, “Approved”, or similar status, it indicates only that certain checks have been performed based on information available to Tidearo at the relevant time. Unless expressly stated otherwise, such status is not a guarantee, certification, endorsement, or warranty of identity, solvency, qualifications, legal compliance, safety, authenticity, or future conduct.

Users should conduct any checks reasonably required before entering into employment, commercial, training, or other arrangements.

6. Companies and Training Providers

Companies using Tidearo must have authority to publish vacancies, access candidate information, contact candidates, and conduct recruitment activities.

Companies must not publish false or misleading vacancies, impersonate another organisation, engage in fraudulent recruitment, or request unlawful payments from candidates.

Companies are responsible for complying with applicable recruitment, employment, immigration, data protection, and anti-discrimination laws.

Training providers are responsible for the accuracy of information concerning their organisation, courses, accreditation, approvals, schedules, locations, prices, entry requirements, certificates, cancellation conditions, and other course information.

Unless expressly stated otherwise, Tidearo does not provide the course itself and does not guarantee that a course, certificate, approval, or accreditation will satisfy a particular employer, flag State, administration, authority, or regulatory requirement.

Any additional terms provided by a training provider may apply directly between the user and that provider.

7. User Content and Communications

“User Content” includes information, text, CVs, profile content, photographs, logos, vacancies, courses, posts, comments, reviews, messages, documents, attachments, and other materials submitted to Tidearo.

You retain ownership of your User Content.

By submitting User Content, you grant Tidearo a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, process, display, transmit, and otherwise use that content only as reasonably necessary to operate, secure, improve, and provide the Services and to make the content available according to the functionality and visibility settings you use.

You confirm that you have the rights and permissions necessary to provide the User Content and that its use through Tidearo does not unlawfully infringe the rights of others.

Messages and communications between users are the responsibility of the participants. Tidearo is not responsible for promises, representations, offers, or arrangements made by other users through the platform.

8. Acceptable Use

You must not use Tidearo to:

  • create false, fraudulent, or misleading profiles, companies, vacancies, courses, or applications;

  • impersonate another person or organisation;

  • conduct recruitment scams, phishing, fraud, or other deceptive activity;

  • publish unlawful, abusive, threatening, defamatory, discriminatory, or infringing content;

  • send unsolicited bulk messages or spam;

  • distribute malware, malicious code, or harmful files;

  • collect, scrape, harvest, copy, or systematically extract profiles, CVs, contact information, listings, or platform data without Tidearo’s permission or another lawful basis;

  • resell or misuse personal information obtained through Tidearo;

  • circumvent access controls, rate limits, account restrictions, security controls, or payment mechanisms;

  • interfere with the operation, security, or integrity of Tidearo;

  • attempt unauthorised access to another account, system, API, or data;

  • use automated systems in a manner not authorised by Tidearo; or

  • use the Services for any unlawful purpose.

Reasonable use of publicly available information for legitimate recruitment or professional purposes remains subject to applicable law and these Terms.

9. Paid Services

Certain Tidearo features may be offered for a fee, including CV distribution, promotional or visibility services, recruitment tools, and other services identified as paid before purchase.

Before you purchase a paid Service, Tidearo will display the applicable price, currency, and material characteristics of that Service.

Payment may be processed by third-party payment providers. Available payment methods may vary by user, country, currency, or Service.

Paid promotion or increased visibility does not guarantee:

  • a particular ranking or position at all times;

  • a specific number of impressions, views, applications, candidates, leads, or contacts;

  • employment;

  • course bookings; or

  • any commercial or recruitment result.

Some Services may begin immediately after confirmation or payment.

Cancellation, refund, re-performance, or credit eligibility depends on the nature of the Service, the stage of performance, any conditions displayed before purchase, and applicable law.

Where a paid Service has already begun or has been fully performed, cancellation or refund rights may be limited to the extent permitted by applicable law.

Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded or waived.

If a paid Service is not materially provided due to an error attributable to Tidearo, you may contact us at support@tidearo.com so that the issue can be reviewed and an appropriate remedy provided where required.

10. Third-Party Services and External Links

Tidearo may interact with or link to services operated by third parties, including payment processors, external employer websites, applicant tracking systems, training provider websites, communication services, mapping services, and other external platforms.

Third-party services are governed by their own terms and privacy practices.

Tidearo is not responsible for the availability, content, security, conduct, or independent actions of third-party services, except to the extent responsibility cannot be excluded under applicable law.

11. Tidearo Atlas and Maritime Information

Tidearo Atlas and other vessel, port, maritime, company, or industry information made available through Tidearo is provided for general professional and informational purposes.

Such information may originate from users, public sources, third-party sources, imported datasets, or other information available to Tidearo and may be incomplete, delayed, or inaccurate.

Tidearo Atlas must not be relied upon as a substitute for official registries, official vessel documentation, navigation systems, AIS equipment, class or flag State records, notices to mariners, or other authoritative or safety-critical information.

Do not use Tidearo Atlas for navigation, vessel operation, emergency response, collision avoidance, regulatory compliance, or other safety-critical decisions.

12. Moderation, Suspension and Termination

Tidearo may use automated tools and/or human review to detect fraud, spam, abuse, unlawful content, security threats, breaches of these Terms, or other misuse of the Services.

Where reasonably necessary, Tidearo may:

  • restrict the visibility of content;

  • remove or disable content;

  • limit particular features;

  • restrict communications;

  • suspend an account;

  • terminate access to the Services; or

  • take other proportionate measures to protect users, third parties, Tidearo, or the integrity of the platform.

These measures may be taken where Tidearo reasonably believes that these Terms have been violated, an account creates a security or fraud risk, action is required by law, or continued access may harm users or the platform.

Where appropriate and legally required, Tidearo may provide information about the reason for a restriction or moderation decision.

If you believe that content or an account action was taken in error, you may contact support@tidearo.com.

Tidearo may preserve information where reasonably necessary for fraud prevention, security, dispute resolution, enforcement, or legal compliance, subject to the Privacy Policy and applicable law.

13. Intellectual Property

Tidearo and its licensors retain all rights in the Tidearo platform, including its software, interfaces, design, branding, databases, platform-generated content, trademarks, logos, and other intellectual property, except for User Content and third-party materials.

These Terms do not transfer ownership of Tidearo intellectual property to you.

You may use Tidearo only for its intended professional and business purposes and in accordance with these Terms.

You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit Tidearo or substantial portions of its protected content except where Tidearo has authorised such use or applicable law expressly permits it.

14. Disclaimers and Limitation of Liability

Tidearo is designed to facilitate maritime professional connections, recruitment, training discovery, communication, and access to professional information.

Tidearo does not guarantee:

  • employment or continued employment;

  • the suitability of any candidate;

  • the authenticity or reliability of every user or organisation;

  • the accuracy of every vacancy, profile, course, message, document, or third-party data item;

  • successful delivery or response to every CV or application;

  • the outcome of recruitment or training;

  • uninterrupted or error-free availability of the Services; or

  • that the Services will meet every user’s specific requirements.

Users are responsible for performing appropriate checks before making employment, recruitment, contractual, financial, training, travel, medical, certification, or other professional decisions.

To the maximum extent permitted by applicable law, Tidearo is not liable for indirect, incidental, special, or consequential losses arising from the conduct of other users, lost employment opportunities, recruitment decisions, third-party services, inaccurate third-party information, or arrangements entered into directly between users.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited, including any mandatory rights available to consumers under applicable law.

15. Privacy, Changes to These Terms and Contact

Your use of Tidearo is also subject to our Privacy Policy, which explains how we collect, use, disclose, store, and protect personal data.

We may update these Terms to reflect changes to Tidearo, legal or regulatory requirements, security considerations, or our business practices.

The current version will be published on this page with an updated revision date.

Where required by law or where a change is materially significant, we may provide additional notice before the updated Terms take effect.

Your continued use of Tidearo after updated Terms take effect constitutes acceptance of those Terms to the extent permitted by applicable law.

Governing Law and Disputes

These Terms are governed by the laws of [COUNTRY OF OPERATOR], without prejudice to any mandatory rights or protections that apply to you under the law of your country of residence.

Subject to any mandatory rules that allow a consumer to bring proceedings elsewhere, disputes relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts of [JURISDICTION].
